Terms of Service

The agreement between you and Pasabay when you use the app or website.

What Pasabay is — and isn't

Pasabay is a coordination and trust layer that connects senders (people who want an item delivered) with travelers who already have spare luggage space on a trip. It digitises the Filipino pasabay/padala tradition, in two models: handoff (the sender gives the traveler an existing item, inspected unsealed at handoff) and shop-and-carry (the traveler buys a requested item new, with a receipt, and delivers it).

Pasabay is not a party to the arrangement between a sender and a traveler. We are not a carrier, courier, customs broker, escrow agent, bank, or payment processor. We do not take possession of, inspect, insure, ship, or deliver any item. Each delivery is an arrangement solely between the sender and the traveler.

Who can use Pasabay

To use Pasabay you must:

  • be at least 18 and able to enter a binding agreement;
  • give accurate registration and identity information and keep it current;
  • use the Service for your own account (or for a recipient or delegate you're authorised to represent); and
  • follow every law that applies to you — including the customs, import/export, tax, and prohibited-goods rules of every country on a delivery's route.

Pasabay is available regardless of where you are, but our operational support focuses on specific corridors. Using the Service doesn't make a delivery lawful on your route — confirming that is your responsibility.

Accounts and identity verification

You need an account to transact, and you're responsible for keeping your credentials secure. To keep the community trustworthy we verify identity: a person reviews your document for identity only — not for immigration, credit, or background — and we use a salted, hashed comparison to enforce one identity, one account. Verification has a retry limit for genuine mismatches; blurry photos can be retaken without penalty. Don't create multiple accounts, impersonate anyone, or submit a false or another person's ID. How the marketplace works

A delivery moves through defined stages, and no step is skipped:

  • A sender posts a request or a traveler posts a trip, and the two are matched.
  • You and the other party arrange the details in chat — what you share there is up to you.
  • At handoff, both parties attest the item changed hands (for shop-and-carry the traveler buys it first and keeps the receipt).
  • On delivery, the recipient's delivery PIN confirms receipt — it is the proof of delivery.
  • After delivery, each party confirms in the app, which completes the transaction and opens reviews.

You agree not to propose on or accept your own listing (self-dealing is blocked), exceed the value or active-transaction limits shown for your tier, or misrepresent an item, its value, or its legality.

Rewards and settlement

Pasabay is free to use and holds no money. We don't charge fees, take commission, process payments, or run escrow — Pasabay never holds, moves, or handles your funds. The reward and any item cost are arranged directly between the sender and the traveler; the amounts shown in the app are there for coordination and record-keeping. Because we hold no funds, we can't refund, reverse, or recover any amount, any money dispute is between the two of you, and you're responsible for the tax treatment of anything you receive. If we ever introduce fees or in-app payments, we'll give advance notice before any charge could apply to you, and they'll never apply to transactions already completed.

Items, prohibited goods, and customs

You're responsible for what you send or carry. You must not request, hand off, buy, or carry anything that is illegal to possess, buy, sell, export, or import on the route, that breaches a carrier's rules or is dangerous, perishable, or hazardous, or that our prohibited-items rules disallow. Senders must declare contents and value honestly; travelers should inspect handoff items unsealed and may decline any item. For customs, you — not Pasabay — are the importer/exporter and declarant, and you're responsible for any duties, taxes, penalties, or seizure. Pasabay does not give customs, tax, or legal advice.

Conduct we don't allow

You agree not to:

  • circumvent identity verification, contact masking, tier limits, or the transaction flow;
  • harass, threaten, defraud, discriminate against, or endanger anyone;
  • post false, misleading, infringing, or unlawful content or reviews;
  • use Pasabay to launder money, evade sanctions, or finance illegal activity; or
  • scrape, reverse-engineer, overload, or attempt to breach the security of the Service.

Reviews and reputation

After a completed transaction, both parties may leave a double-blind review within the review window. Reviews must be honest and based on the actual transaction. Ratings, review history, and dispute outcomes are central to trust on Pasabay and may be shown to other users. We may remove reviews that break these terms.

Disputes between users

Because Pasabay holds no funds and isn't a party to a delivery, disputes are resolved between the sender and the traveler. We provide a channel to report an issue with evidence. Any outcome is reputational — it may be recorded on a member's record — and is not a payment, refund, or financial award. We don't promise mediation, a set response time, or compensation, though timers on a transaction may pause while a dispute is open.

Your content

You keep ownership of what you submit — listings, messages, photos, avatars, and reviews. You grant Pasabay a non-exclusive, worldwide, royalty-free licence to host, store, adapt (for example crop an avatar), and display that content solely to operate, secure, and improve the Service. You're responsible for your content and confirm you have the right to submit it. We may moderate or remove content that breaks these terms or the law. The licence ends when your content is deleted, except for copies the law requires us to keep or that were already shared with others.

How we moderate, and reporting illegal content

We moderate to keep Pasabay lawful and safe. Automated checks help us find problems — screening names against sanctions lists, rate limits, blocked categories and routes — but a person makes every decision to remove content or restrict an account. We act on reports and on our own checks, and we apply these terms diligently, objectively and proportionately.

Anyone can report content they believe is illegal, with or without an account — see “Reporting illegal content”. If we remove your content or restrict your account, we will tell you what we did, why, and how to challenge it.

Disclaimers and liability

To the fullest extent the law allows, the Service is provided “as is” and “as available.” Pasabay does not warrant that any item will be delivered, genuine, undamaged, lawful, or as described, that any user is trustworthy or will pay, or that the Service will be uninterrupted. We are not responsible for the acts, items, payments, or legality of any sender, traveler, recipient, or delegate.

Nothing here excludes or limits our liability for death or personal injury, for fraud or fraudulent misrepresentation, for deliberate wrongdoing or gross negligence, or for anything else that cannot be excluded under the law that applies to you. If you're a consumer, your mandatory statutory rights are unaffected.

Suspension, termination, and changes

You can stop using Pasabay and delete your account at any time, after finishing any active delivery. We may suspend or end an account that breaks these terms or the law, fails verification, or creates risk for others. We may update these terms; if a change is material we'll give advance notice by a reasonable means and, where the law requires, ask you to accept it before it applies. The revised date below shows the current version.

Governing law and contact

Pasabay is operated by Sisu Software Oy (business ID 3634070-1), registered in Finland. These terms are governed by Finnish law, without depriving you of the mandatory consumer protections of the country where you live. EU consumers may also take a dispute to Finland's Consumer Disputes Board, and the European Consumer Centre network can help with a cross-border complaint; consumers in the Philippines and Japan keep the rights available under their local law.
